In the court of common Pleas District of the Arkansas To December Term for the year of our Lord one thousand eight hundred and Ten—

Sylvanus Phillips by his Attorney comes here into court before the Honorable Judges and complains of Richmond Peeler in a Plea of Trespass with force and Arms for that the said Peeler at Arkansas aforesaid by his Petition and complaint unto Francois Vaugine Esquire Presiding Judge of the court of common Pleas aforesd Did sue out a warrant against your complainant and cause him to be arrested on said warrant with force and Arms have brought him before the Said Judge and Joseph Stilwell associate and further the said Sylvanus Phillips sayeth that from the third of November instant until the Sixteenth he hath been forcibly Detained Draged from his home and family by the Said Peeler wilfully and Maliciously contrary to Law the courts or Judge to which the Said Peeler applied having no cognizance of the cause neither was this Plaintiff Subject to an arrest by any Such matter the Law having clearly Pointed out his remidy which the Plaintiff has Duely notified the Defendant of notwith Standing [image of page 2] he the Said Peeler hath Still Knowingly wilfully and maliciously caused your Petitioner to be Detained as a prisoner without the means of Defence or any inquiry into the Legal cause of his Detention for the purpose of being released and that council or an investigation of the right Hath been Refused to this Defendant in the former cause all which acts and Doings are cruel oppressive and Subversive of Law and that personal protection which it gives to freemen and citizen and to the Damage of the Plaintiff Five hundred Dollars for the recovery of which together with cost the Said Phillips brings Suit and Sayeth that the Same was Done in the District of Arkansas aforesaid within the jurisdiction of the court aforesaid and that all Papers and Dockuments necessary for the Proof or investigation of Said cause will be herewith Shewn in court on Trial

We command you Summons Richmond Peeler if he may be found within your Bailiwick that he be and appear before the Judges of our court of common pleas, to be holden at the Town of arkansa in and for the Destrict of arkansa on the first Monday in December next then and there to answer unto Sylvanus Phillips of a plea of Trespass Vi et armis to the Damage of Phillips aforesaid as he says the Sum of five hundred Dollars and have you then there this Writ.
