the Common Pleas
April Term 1811 } in the Territory of Louisiana
and whereas afterwards (to wit) on the same day and year last aforesaid at Arkansaw aforesaid, in the District aforesaid was indebted unto the said Robert Clary in other one Hundred and Seven Dollars and thirty three cents like lawful money of the united States for money, he the said John (D) Chisholm had and received of the said Robert Clary, for his the said John (D) Chisholm's use, and being so indebted he the said John (D) Chisholm in consideration thereof afterwards (to wit) the same day and year aforesaid at Arkansas aforesaid, in the District aforesaid, undertook and then and there faithfully promised the said Robert Clary, to pay him the said sum of money last mentioned, when [image of page 2] he should be thereunto afterwards requested but the said John (D) Chisholm not regarding his said several promises & undertakings as aforesaid although often requested, but deceitfully intending to defraud the said Robert Clary, has hitherto wholly neglected & refused to pay the said several sums of money, to the Damage of the said Robert Clary four Hundred & fourteen Dollars & Sixty Six cents-and therefore he sues A.
