Robert Clary complains John (D) Chisholm in a plea of trespass on the case and whereupon the said Robert Clary by his attorney A. Haden complains for that whereas the said John (D) Chisholm on the 13^th day of September in the year of our lord 1810 was justly indebted to the said Robert Clary in the sum of two hundred & seven Dollars & 33 cents lawful money of the united States; for whisky corn pork beef bacon & flour; before that time had and received of the said Robert Clary; by the said John (D) Chisholm at his the John (D) Chisholm's special instance and request, and being so indebted he the said John (D) Chisholm in consideration thereof; afterwards to wit the same day & year aforesaid; at Arkansaw aforesaid; in the District of Arkansaw aforesaid undertook & then and there faithfully promised the said Robert Clary;—to pay him the said sum of Two Hundred & Seven dollars & thirty three cents When he should be therewith afterwards requested

and whereas afterwards (to wit) on the same day and year last aforesaid at Arkansaw aforesaid, in the District aforesaid was indebted unto the said Robert Clary in other one Hundred and Seven Dollars and thirty three cents like lawful money of the united States for money, he the said John (D) Chisholm had and received of the said Robert Clary, for his the said John (D) Chisholm's use, and being so indebted he the said John (D) Chisholm in consideration thereof afterwards (to wit) the same day and year aforesaid at Arkansas aforesaid, in the District aforesaid, undertook and then and there faithfully promised the said Robert Clary, to pay him the said sum of money last mentioned, when [image of page 2] he should be thereunto afterwards requested but the said John (D) Chisholm not regarding his said several promises & undertakings as aforesaid although often requested, but deceitfully intending to defraud the said Robert Clary, has hitherto wholly neglected & refused to pay the said several sums of money, to the Damage of the said Robert Clary four Hundred & fourteen Dollars & Sixty Six cents-and therefore he sues
