In Court common Pleas April term for the year of our Lord one thousand Eight hundred and Eleven—

Perly Wallis

 

 

 

And the Defendant Perly Wallis in his own Proper Person comes and Defends the wrong and injury when and wherefore and sayeth that the said John ought not to have and maintain his said action against him for this that it is Provided in the Twenty Third Section of a Law of this Territory instituted and act for the recovery of Debt and Demand, not exceeding Sixty Dollars before a Justice of the Peace That the several courts of Record in this Territory shall take no cognizance of any action suit or complaint made cognizable before a Justice of the Peace by this act except in cases of appeal and certiorari herein proceeded one a Plaintiff instituting a suit in a court of record which by this act is made cognizable before a Justice of the Peace shall have his writ abated with cost and the said Wallis payeth the said suit if Prosecuted against him for fifty Dollars and not cognizable in any court of record wherefore he prays judgement whether the court will take further cognizance of the cause as the Defendant is ready to verify the facts above alledged by Perly Wallis refference being had to the paper and statute And for further Plea the the said Wallis with leave of the court sayeth he hath payed Seventy five Dollars by a note delivered unto said Dill on Isaac House on which Dill obtained a Judgement before Squire brooks of Natchez which the said Dill was to account for and indorse on said note which this Defendant is ready to verify and pray said suit may be dismissed at the oath of the Plaintiff
