Grand Jury Writ of Venire
for March 1812
Abstract
|
The Court convened on Monday, March 30, 1812. Presiding were judges Benjamin Fooy, Samuel Moseley, and Henry Cassidy. Daniel Mooney was sheriff, and Patrick Cassidy, clerk. Grand jurors in attendance were Hewes Scull, John Hendry, Joseph Dardannes, John and Alex Jardelas, Louis Demont, Joseph Bougy, August Surville, John Larkey, Robert Jones, Pierre Pertuis, Charles Refeld, Curtis Wilbourn, Asher Bassey, Jacob Stanley, Christopher Kauffman, John McCartney, Peter Lefevre, James C. Newal, Harold Stillwell, Seth Derickson, Lewis White, John W. Hunt, and Robert Aljou. August Surville was not present and the court fined him four dollars unless he could explain his absence. The court appointed Hewes Scull the foreman of the grand jury. John Miller presented a license to practice law signed by John B.C. Lucas, one of the Judges of the General Court. He also presented a commission to prosecute, and so served as the prosecuting attorney during the March session. The previous term, Peggy Chisholm had been indicted for assault and battery, but she answered that she was a Cherokee Indian, and so the court discharged her. Because of her Indian status, the court had no jurisdiction over her. The grand jury indicted John Wilson for murder. At trial, William Bassett was found guilty of mismarking one calf and feloniously taking one cow and yearling from Sylvanus Philllips. He was fined nine dollars. John McClain changed a not guilty plea to guilty of assault and battery and was fined one dollar. In the case of the United States v. John Webster, the jury found Webster guilty of robbery, assault and battery, and breaking the peace. He was fined $300 for the criminal charge of robbery, and $300 in private damages to Perly Wallis, for Wallis's damages. |
