John Miller Esqr in his own proper person comes into court and complains of Henry Cassidy in a Plea of trespass on the case, For that whereas the aforesaid John Miller Esqr now is a good, true, honest and faithful Citizen of the Territory of Louisiana, and as such a good, true, honest, and faithful Citizen from the time of his nativity hitherto hath always behaved and governed him selfe and has untill the time of the Speaking and Publishing of the Several false, feigned, Scandalous, Malicious, and opprobrious English words hereafter mentioned, been held and respected amongst all his neighbours and other worthy Citizens of the Territory afsd, to be a man of good name, fame, credit, and reputation, and has always During his lifetime, hitherto Lived and continued free, unspotted, and untill the time of the Speaking and Publishing of the Several false, feigned, Scandalous, and opprobrious English words hereafter mentioned, wholly unsuspected of and from all manner of fellony, robery, theft, Larceny Cheating, Swindelling, Perjury or fraud, or of any other Such hurt ful Crime; by means of which Said Premises he the Said John Miller before the Speaking and Publishing of the Several false Scandalous and opprobrious words hereafter [image of page 3] mentioned, had deservedly obtained and procured to him selfe the benevolence, good opinion and credit of all Persons any ways acquainted with him, and other good and worthy Citizens of the District and Territory aforesaid, to wit, in the District of Arkansas aforesaid yet the aforesaid Henry Cassidy well knowing the Premises, but greatly enveying the happy State and Condition of the afsd John Miller, and continuing and maliciously intending not only to hurt, degrade, damnify, and injure him the afsd John Miller in his good name fame credit and reputation, but also wrongfully to subject him to the Pains and Penalties by the Laws and Statute of the Territory, made and Provided against Fellons robers thieves swindellers &c on the Tenth day of May one thousand Eight hundred and twelve at village of arkansas in the District and Territory afsd, in a certain Discourse which he the afsd Henry Cassidy then and their had with a number of the good Citizens of the district of Arkansas & Territory afsd of and concerning the aforesaid John Miller Esqr in the Presence and hering of Divers good and respectable Citizens of the District aforesaid, then and their falsely and maliciously Said, rehersed and Proclaimed and Loudly Published these false, feigned, and Scandalous, malicious, and opprobrious English [image of page 4] words following, to, of and concerning the Said John Miller, in the Presence and hering of those Citizens that is to say he (meaning the said John Miller Esqr) is a thief, and stole my table (meaning a table of his the afsd Henry Cassidy) and I meaning himselfe will Prosecute the afsd Miller for stealling my table (and he Still meaning the afsd John Miller Esqr is a thief and Stoat [stole] all the Books he has in his Library marked with the name of Peter Walker from the Shelves of the afsd Peter Walker Decd and meaning him selfe will Prove it (And he still meaning the afsd John Miller Esqr is a theaf and Stoat [stole] two Deeds the one for twenty Thousand acres of Land given to Peter Walker Esqr by Elisha Winters the other an agreement for the Quantity afsd given by the afsd Henry Cassidy to the aforesaid Peter Walker Esqr and he still meaning the afsd John Miller Esqr Stoat [stole] the afsd Books and Deed from amongst the effects of Peter Walker, and I meaning him selfe will Prosicute him meaning the afsd Miller for Larceny, and he Still meaning the afsd Miller is a Swindeller and obtained a negrow named Sam from Sylvenus Phillips by Swindelling and Perjury and I meaning him sefe the afsd Henry Cassidy will Prove it [image of page 5] And after wards (to wit) on the Same day and year aforesaid at village of Arkansas in the District and territory afsd in a certain other Discourse which the said Henry Cassidy then and their had with Divers other good and worthy Citizens of the District and Territory aforesaid of and Concerning the Said John Miller Esqr, Then and their falsely and maliciously Said, rehersed, and Proclaimed, and Loudly Published these other false feigned Scandalous, malicious and opprobrious English words following of and Concerning the Said John Miller he meaning the Said John Miller Esqr is a pretender and imposter and no Lawyer, and he Still meaning the afsd John Miller Esqr is a thief and Stoal his License from the Honorable John B.C Lucas one of the Judges of the general Court authorised to grant Licenses to all those who are Duely Quallified to Practice in the territory afsd (and he Still meaning the afsd Miller is a Pretender and no regular Lawyer which I can make appear well knowing that he the afsd John Miller Esqr was then and Long previous Duely Licenced to Practice [image of page 6] Law in the Superior and inferior Courts of the Territory of Lousiana (and he still meaning the afsd John Miller Esqr is a Soundrel and Perjured villan and has done enough to Send him to the State Prison, and I meaning him selfe will Prosecute him still meaning the afsd John Miller Esqr and Send him to the State Prison and I still meaning him selfe the afsd Henry Cassidy will Prove the afsd John Miller Esqr a thief Scoundral and Perjured vallan and I Still meaning him selfe will dig up or cause to be Dug up the Dead Body of Phebe Miller Decd the wife of the afsd John Miller Esqr and I meaning him selfe will tie a roap round the neck of him meaning the afsd John Miller Esqr And if he meaning the afsd John Miller Esqr opposes me meaning him selfe in Diging up the Dead Body of his wife meaning the Dead Body of Phebe Miller Decd the Late wife of the afsd John Miller and In tying the afsd roap Round his neck meaning the afsd John Miller and in Beating him until he meaning the afsd John Miller owens himselfe [image of page 7] Guilty of Stealing Swindelling and Perjury I meaning him selfe the afsd Henry Cassidy will take the Life of him meaning the afsd John Miller Esqr By means of the Speaking and publishing of which Said Several false, feigned, Scandalous, malicious and opprobrious English words, and of the Said Publication and assersion of the Slander aforesaid the Said John Miller is very much prejudiced, hurt, and Damnified in his good name, fame, credit and reputation, and is fallen into Publick Scandal and Disgrace, among all his neighbours and other good and worthy Citizens of the Territory afsd to whome he was known, Insomuch that Divers of the Citizens to whome the Innocence and integrity of the Said John Miller Esqr in Premises were unknown, have always from the time of Speaking and Publishing of the Said words and Slander That they upon that account have wholly refused to have any commerce or Discourse with him or have any thing to do with him as they were before accustomed to have and otherwise again would have had [image of page 8] and the Said John Miller is on occasion of the Premises aforesaid in other respects greatly injured both in his reputation and business to the Damages of the aforesaid John Miller fifteen Thousand Dollars wherefore he brings suit &c John Miller Territory

We Command you that you Summons Henry Cassidy if he may be found in your bailiwick that he be and appear before the Judges of our Court of Common pleas to be holden at the town of Arkansas in and for the district of arkansas on the fifth Monday of November next then there to answer unto John Miller in a plea of trespass on the case to his damage as he says fifteen thousand dollars and have you then there this Writ (red
