Samuel Moseley by his Attorney Anthony Haden complains of Benjn Murphey for that whereas the said Benjn Murphy on the 10th day of February one thousand Eight Hundred & thirteen at arkansas aforesaid in the County of Arkansas made his certain note in righting commonly called a promissory note; or receipt, Subscribed Subscribed with his own proper hand beareing date the day & year aforesaid; and then and there delivered the said note (or receipt) to the said Samuel Moseley to the use of the said Samuel and by the said note or receipt acknowledged the receipt of goods wares and merchendise to the amount of Six Hundred & Fifty Two Dollars Eighty Two & one half cents at the prices stated in Bill thereto [?] within; named; and by the said note or receipt promised to pay the said Samuel the Six Hundred and fifty Two Dollars Eighty Two & one half cents to be paid to the said Samuel on or before the first day of June insuing the date thereof in Bever at Two Dollars per pound (french weight) the Bever to be of the very first qullity part in good Tallow at Twelve & a half cents per pound french weight first quallity, [?] at Two Dollars each; part in first quallity Bear skins one Dollar each & parts in first quallity Raccons at Twenty five cents each, a part in shaved Deer skins at twenty cents per pound french weight, & haird Deerskins at fifteen cents per pound french weight both to be receiptable the residue of said goods if any to be returned to the said Samuel Moseley on the first [image of page 3] of January insueing the date thereof for the value stated in the said Bill; note attested by the said Benjn Murphey, & by reason thereof Benjn Murphey became liable to pay the said Samuel Moseley the said sum of money contained in the said note according to the tenor and effect of said note; yet the said Benjn Murphey not regarding his said [missing] promises and undertakings aforesaid in form aforesaid made but contriving and fraudulently intending; craftily & subtelly to deceive and defraud the said Samuel Moseley in this particular, hath not yet paid the said sum of money to the said Samuel Moseley (although to do this, he the said Benjn Murphy, afterwards, towit, in the same day and year last aforesaid, at the place aforesaid, at the county aforesaid, by the said Samuel Moseley was requested) bid he to pay the same to him, hitherto hath wholly refused and still doth refuse to the said Samuel Moseley his damage one thousand three Hundred & five Dollars and Sixty five cents & therefore he brings suit.

Personally appeared before clerk of the General Court in and for the County of Arkansas Samuel Moseley who being sworn says there is a real Subsisting debt due from Benjamin Murphy to the Said Said Samuel Moseley and that he verily believes that the Said Benjamin Murphy ought to be held to bail in the Sum of five hundred & fifty dollars in this action to Secure the debt and Costs in this behalf. Sworn to and Subscribed before me as clerk of said Court this 22nd day of July 1814

We command you that you take Benjamin Murphy if he may be found within your bailiwick and him safely keep so that you have his body before the Judge of our General Court to be holden in the Town of Arkansas in and for the county aforesaid on the first monday in September next it being the first day of the Term then and there to answer the within named Samuel Moseley in a plea of debt for Six hundred and fifty two Dollars Eighty two and one half cents and to his damage one thousand three hundred five dollars and Sixty five cents and have you [then there this writ]
Witness the honorable George Bullitt Judge aforesaid court at Arkansas the 22nd day of July A.D. 1814 and of our Independence the thirty ninth.
