Personally appeared before me John ? a Justice of the Peace for the County aforesaid Samuel Goldsbury a soldier in the 7th Regt. Inftry stationed at Fort Smith who being duly sworn Deposeth and saith; that on the 10th day of June 1822 he the deponent in company with Elias Staples Benj. Clark and Daniel McCranie soldiers of the same Regt. & station was going out about one mile from Fort Smith to work, and on their way Daniel McCranie asked Benj Clark for a Due bill & Dollar which Clark had to keep for him– Clark replyed that he ought to have kept it if he wanted it–The Deponent saith that after they had arrived at the Tree for work Daniel McCranie asked Clark again for the Due bill and money; Clark replying that it was [Image of page 3] not with him when McCranie insisted that Clark should return after it, and Clark then replyed "I will be damed if I do"– McCranie sitting on the log asked E Staples for the broad axe and Staples replyed that it was near the but of the Tree or sitting against the stump The Deponent stending on the log with his back towards Clark in a short time heard a blow and something fall, and turning round on the log saw Benj. Clark laying on the ground, and heard something like blood gushing out of veins; then looking up saw Daniel McCranie running through the bushes and being alarmed returned to the Fort and reported to Capt. Young; who returned with the Deponent to the place where Benj. Clark lay dead–
