William Russell Filed February 21st 1823 Executed in Ozan Township March 14th 1823 Service $...80 Territory of Arkansas In the Superior court of and for the Territory of Arkansas to April term
of said court in the year one thousand eight hundred and twenty three
William Russell plaintiff by his attorney complains of Simeon English
administrator of all and singular the goods and chattels, rights, [missing]
of John English deceased, at the time of his death who died intestate,
& to of a plea that he the said defendant render unto him this said
plaintiff the sum of five hundred and eighty three dollars thirty three
and one third cents current money of the united states which he the said
Simeon administrator of the aforesaid unjustly detains from him the said
Russell For that whereas the said John English in his lifetime to wit
on the twentieth day of June in the year one thousand eight hundred twenty
one in the county of Pulaski & within the ? the said John English
of his certain writing obligatory signed with his proper hand and sealed
with his seal and now hereunto this court shewn the date whereof is of
the same day and year as last aforesaid on or before the twentieth day
of June one thousand eight hundred and twenty two promised for value received
to pay or cause to be paid to William Russell his heirs or assigns the

hundred and eighty three dollars thirty three and one third cents in current
money of the United States with interest at the rate of ten percent a
year from the time the same becomes due until paid and a discount at the
same rate if paid before it becomes due the said John English in his lifetime
and the said same the said Simeon English administrator of aforesaid after
[missing] the said John English not regarding his promises and obligatory
agreement of him the said John English but contriving fraudulently and
subtly to deceive and defraud the said Russell in this behalf have not
nor hath either of them paid the aforesaid owing five hundred and eighty
three dollars thirty three and one third cents to the said Russell ? ?
thereof altho often requested so to do But to pay this [missing] or any
part thereof to the said Russell the said John English in his lifetime
wholly neglected and refused and the said Simeon administrator as aforesaid
have ever since the death of the said John English hath thereto hath wholly
refused and still doth refuse for to do to the damage of the said William
Russell five hundred dollars and therefore he sues &c the clerk of the Superior court will please issue a summons on the foregoing
declaration directed to the sheriff of Hampstad county and endorse this
is an action of debt for $583.33 1/3 Damage $500 no bail required
