James Scull v. George Bentley

James Scull Trover &c Filed February 21st 1823 We of the Jury find for the Plaintiff Ninety dollars, in damages. Wm Woodruff [left side of page] served this within Writ & Declaration on the within named George Bently, by the reading the same to him in the Welborn township, March 17, 1823. T.W. Newton D Shff Territory of Arkansas To April Term of the Superior court in the Territory of Arkansas in the year of our Lord one thousand eight hundred twenty three James Scull Plaintiff by Ambrose H. Sevier his attorney complains of George Bentley defendant being in the custody &c of a plea of trespass on the case &c In that whereas heretofore to wit on the first day of august in the year one thousand eight hundred and twenty one at the county of Arkansas and within the jurisdiction of this court, the said James Scull plaintiff was lawfully possessed as of his own property of a certain Gray horse, about eight or nine years old, branded on the left shoulder with the letter A about fourteen and a half or fifteen hands high of great value to wit of the value of one hundred and fifty dollars lawful money of the United States and being so possessed thereof he the said James Scull Plaintiff afterwards to wit on the day and year last aforesaid of the county and within the jurisdiction aforesaid cassualy lost the said horse of his possession and the same afterwards to wit on the day and year last aforesaid and within the jurisdiction aforesaid came to the possession of the said George Bently defendant by finding yet the said George Bently unbeknowing the aforesaid gray horse to be the property of him the said James Scull and of right to belong and appertain to him hath not as yet delivered the said horse to him the said James Scull but contriving and fraudulently intending to defraud and deceive him in this behalf hath not as yet delivered sd horse although often requested so to do and afterwards to wit on this date and [Image of page 3] year last aforesaid converted and despossd of the aforesaid gray horse to his own use To the damage of the said James Scull two hundred dollars and therefore he sues &c A. H. Sevier P.Q. The clerk of the Superior court will please issue a summons on the foregoing declaration directed to the sheriff of Pulaski county and endorse thereon this is an action of trover & conversion. no bail required. To the Sheriff of Pulaski County Greeting: You are hereby commanded to summon George Bentley to appear before the Judges of our Superior Court, at the Court House in the town of Little Rock, on the first day of our next term, then and there to answer James Scull to a plea of Trover and Conversion two hundred dollars damage and that you made due return of this writ to our said Court.
