Reuben Blount Filed 14th May 1823 [right side of page] Executed the within writ by Reading the within Declaration & writ to Deft In-Pecan Township July 22nd 1823 Service $.80 Claybour ? In the Superior Court in & for the Territory aforesaid to the August term of said Court in the year 1823 Reuben Blount assignee of Benja alias Benjamin Murphy by Ambrose H. Sevier his attorney complains of Johnathan Hampton of a plea that he the said defendant render unto him the said plaintiff the sum of one Hundred and eight dollars lawful money of the United States which he the said defendant owes to and unjustly detains from him the said plaintiff For that whereas heretofore to wit on the fifteenth day of July in the year one thousand eight hundred and eighteen at the County of Pulaski and within the Jurisdiction of this Court the said defendt by his certain promissory note in writing bearing date the day and year last aforesaid and now heretofore to the court shewn signed with the proper hand of him the said defendant promised to pay the said Murphy or order nine months after date the sum of one hundred and eight dollars. And the said Murphy to whom or to whose order the payment of the said sum of one Hundred Eight dollars as specified in said promissory note to wit on the seventeenth day of december in the year one thousand eight hundred and twenty two and within the jurisdiction aforesaid assigned said promissory [Image of page 3] by which said assignment he the said Murphy for value received then and there assigned said sum of one Hundred and eight dollars to be paid to the said Blount and then and there delivered the said promissory note so endorsed or assigned as aforesaid to the said plaintiff, by means whereof and by the force of the Statute on such cases made and provided the said Hampton then & became liable to pay the said plaintiff the said sum of one Hundred and Eight dollars the sum specified in said note according to the term and effect of said promissory note; and being so liable he the said defendant in consideration thereof afterwards to wit on the day and year last aforesaid within the jurisdiction aforesaid undertook & then & there faithfully promised the said plaintiff to pay him the said sum of one Hundred and Eight dollars in said promissory note specified according to the terms and effect thereof yet the said Hampton although often requested so to do did not pay the aforesaid sum of one Hundred and Eight dollars to said Murphy previous to the said assignment as aforesaid to the said Benjamin Murphy or any part thereof now hath he the said [Image of page 4] defendant since the assignment of the said sum aforesaid in said promissory note as aforesaid paid the aforesaid sum of one Hundred and Eight dollars to the plaintiff but to pay the same or any part thereof hath Hereunto wholly neglected and refused and still doth neglect and refuse to the damage of the said plaintiff one Hundred and fifty dollars & therefore he sues &c A.H.
