Charles Kelly v. Christian Brumback
Abstract

On October 14, attorney Townsend Dickinson filed suit in the Superior Court for his client, Charles Kelly. Kelly alleged that on Dec. 2, 1823, Christian Brumback had signed a promissory note, witnessed by John Redmon, to pay him $237.50 before the following July 1. Kelly alleged that Brumback had not paid him, and sued in debt. Clerk David McKinney accepted the declaration and issued a capias writ for Brumback, noting that bail would be set at $300. Only the note, the declaration and the order for the writ are present in this collection. The court record book notes that on October 16, Brumback acknowledged his debt. The execution was stayed until the following April. There is no entry during future terms; perhaps Brumback paid off the debt before April.
