In the Circuit Court Superior Court in and for the County of Pulaski Territory of Arkansas aforesaid of November October Term in the year of our Lord one thousand eight hundred and twenty four
Charles Kelly by Dickinson his attorney complains of Christian Brumback of a plea of Five hundred and thirty Seven Dollars and fifty cents which he owes to an unjustly detains from him- For that whereas the said defendant heretofore to wit, on the Second day of December in the year of our Lord one thousand eight hundred and twenty three at the County of Pulaski and within the Jurisdiction of this Court made his certain writing obligatory of that date Sealed with his Seal and now here to the Court shewn By which said writing obligatory he the said defendant promised to pay to said Charles Kelly or order Five hundred and thirty seven Dollars and fifty cents on or before the first day of July thence next ensuing the date of said writing obligatory for value received Yet the said defendant not regarding his said promise and undertaking aforesaid in form aforesaid made but, intending to deceive and defraud the said plaintiff in this behalf to pay said sum of Five hundred and thirty seven Dollars and fifty cents as in said writing obligatory specified or any part thereof hath hitherto wholly refused and still doth refuse to the damage of said plaintiff of three hundred Dollars and therefore he sues &c

The Clerk of the Circuit Superior Court for the County of Pulaski will please issue a capias on the foregoing Declaration and indorse the Same an action of Debt for Five hundred & thirty seven Dollars & fifty cents founded on a writing obligatory Bail required in the Sum of three hundred Dollars
