Alex S. Moore Roane atty. Filed 3d day of Term 1825. 1828 Apl. Mo. to reconsider overruled Costs Taxed Fee Book mo.over. Come to hand Aug 2nd 1825 Executed the within by taking the body of Joseph Paxton into custody which was released by his entering into bond & Security at Little Rock Sept.22nd 1825 Service 1.00 Territory of Arkansas } In the Superior Court in & for said Territory to Oct. Term AD 1825 Alexander Spotswood Moore by his attorney Sam C Roane complains of Joseph Paxton of a plea that he render unto him the said Plaintiff the Sum of one thousand forty nine dollars and thirty five cents which he owes to and unjustly detains from him For this whereas the said Plaintiff heretofore towit at the March Term 1818 of the Court of Common Pleas at the Sumpter Court house in the District of Sumpter in the state of South Carolina before the associate Judges of the said state at the court of Common Pleas held at Sumpter Court house for Sumpter District in the said state of South Carolina by the consideration and Judgment of said Court recovered against the said Defendant (Joseph Paxton) the Sum of one thousand and forty nine dollars and thirty five cents above demanded which in and by the said court were then and there adjudged to the said Plaintiff for his damages which he had sustained as well by the reason of the speaking and publishing by the Defendant of certain false malicious and Slanderous words of and consarning the defend Plaintiff sub then lately spoken and Published by the defendent as for his costs and charges by him about his suit in that behalf expended whereof the said Defendant was convicted as by the record and proceedings thereof remaining in the said court of Common Pleas at Sumpter Court house in the District of Sumpter in the State of South Carolina to wit in the Territory of Arkansas more fully appears which Judgement still remains in full force & effect not recovered satisfied or otherwise vacated and the said Plaintiff hath not abandoned any execution or satisfaction [Image of page 3] of or upon the said Judgment so recoverd as aforesaid whereby an action hath accrued to the said Plaintiff to demand and have of and from the said defendent the said Sum of one thousand and forty nine Dollars and thirty five cents above demanded yet the said Joseph Paxton although often requested so to do hath not as yet paid the said sum of one thousand and forty nine dollars and thirty five cents above demanded or any part thereof to the said Alexander Spotswood Moore but he to do this hath hitherto wholy failed & refused and still doth refuse, To the damage of the said Alexander Spotswood Moore five hundred dollars and therefore he brings his suit Sam C. Roane att for Plff John Doe S C Roane Know all by these presents that we Alexander S. Moore and The condition is that that the said Moore has brought suit against Joseph Paxton now if sd. Moore shall abide the decision of the Supr. Court. or Sd Daniel shall the Same for him then this obligation to be void else to remain in force and virtue (seal) S.C.Roane (seal) |
