Etienne Vaugine complains of Francois Coussotte of a plea that he render to him one hundred and forty five dollars and twelve and a half cents which he owes to and unjustly detains from him. For that whereas the said Francois heretofore to wit [?] on the sixth day of September in the year of our Lord eighteen hundred and twenty four at the Township of Vaugine in the Territory and County aforesaid made his certain writing obligatory sealed with his seal and bearing date the day and year aforesaid which is here in court ready to be shewn and then and there delivered the said writing obligatory to the said Etienne by which said writing obligatory he the said Francois then and there two months after date (meaning the date of said writing obligatory) promised to pay to the said Etienne Vaugine or order the sum of eighty seven dollars for value received, part of the sum of one hundred and forty five dollars and twelve and a half cents above mentioned and whereas the said Francois on the twenty ninth day of November in the year of our Lord eighteen hundred and twenty four at the county aforesaid made on other [another] writing obligatory sealed with his seal and bearing date the day and year last aforementioned [image of page 3] and then and there delivered the said writing obligatory to the said Etienne by which said writing obligatory he the said Francois then and there in all the month of January next (meaning after the date of said writing obligatory ) promised to pay to Etienne Vaugine or order the sum of seventeen dollars and twelve and half cents for value received part of the first mentioned sum of one hundred and forty five dollars and twelve and a half cents and whereas the said Francois on the tenth day of May in the year of our Lord eighteen hundred and twenty four at the county aforesaid made one other writing obligatory sealed with his seal and bearing date the day and year last aforesaid and here in court ready to be shewn and then and there delivered the said writing obligatory to the said Etienne by which said writing obligatory he the said Francois then and there promised to pay three months after the date thereof to the said Etienne Vaugine the sum of forty one dollars for value received making the sum of one hundred and forty five dollars and twelve and a half cents as first aforesaid by [?] whereof and by force of the Statute in such case made and provided. The said Francois then and there became liable to pay to the said Etienne the said sum of money in writings obligatory specified according to the tenor and effect thereof and although the said several sums of money in said writings obligatory specified hath been long since due and [image of page 4] payable according to the tenor and effect thereof yet the said Etienne in fact saith that the said Francois although often requested so to do did not nor would pay the said several sums of money in said Writings obligatory specified or any part thereof To the said Etienne in manner aforesaid or otherwise howsoever but hath hitherto wholly neglected and refused so to do whereby an action hath accrued to the said Etienne to demand and have of and from the said Francois the sum of one hundred [?] five dollars and twelve and a half cents in said several writings obligatory specified which he unjustly detains to the damage of the said Etienne three hundred dollars therefore he brings suit &c.
