St Lanusse Nee Macarty Complains of William Flanakin of a plea that she the defendant Tendered to him the plaintiff one Mulatto Boy Slave Named Toby of grate value To witt of the value of Seven hundred dollars which from her the defendant unjustly detains.
For that whereas the plaintiff on the first day of August in the year of our lord one thousand eight hundred and twenty five was possest of a certain Mulatto Boy Slave about twenty one years of age of grate value towitt of the value of Seven hundred dollars of her own proper Slave Now at the County of Conway afsd formerly at the County of Pulasky afsd and Territory of Arkansa afsd the same Mulatto Boy Slave and of her possession and being thereof so possest afterwards towitt the same day and year afsd in the County and Territory afsd The Same Mulatto boy slave out of her possession Casually lost And whereas afterwards Towitt the Same day and year afsd in the County and Territory afsd The Same Mulatto Boy Slave to the hands and possession of the defendant by finding Came. Nevertheless the said defendant well knowing the Said Mulatto boy Slave to be the proper slave of the [Image of page 3] Said plaintiff and to her of Right to belong hath not (although often Required so to do) delivered the Said Mulatto Boy Slave to the plaintiff But hath hitherto altogether Refused and still doth Refuse and unjustly detain from her the Said plaintiff in the County afsd and Territory afsd To the damage of her the Said plaintiff one Thousand dollars and therefore she brings her suit

And that he believes that William Flanakin the Said defendant unlawfuly detains the same

St Lanusse nee Macarty the within named Plaintiff having filed in my office and Affidavit stating that the property in the Declaration mentioned is her property, and that she is lawfully entitled to the possession thereof, and that the same is of the value of Seven hundred dollars; It is therefore Ordered that the Defendant be held to bail in the Sum of Fourteen hundred dollars-

To the Sheriff of Conway County– Greeting:
WE command you to take the body of William Flanakin if he be found in your bailiwick, and him safely keep, so that you have his body before the Judges of our Superior Court, at the Court-House in the town of Little Rock, in the county of Pulaski, on the first day of our next October term, 1826 then and there to answer St Lanusse nee Macarty to a plea of Detinue for a Negro boy named Toby or the value of sd Boy damage One thousand dollars and that you make due return of this writ to our said Court.

IN TESTIMONY WHEREOF, I have hereunto set my hand as Clerk, and affixed the seal of office, this 15th day of August 1826, and of the Independence of the United States the forty-first
