St Lanusse Nee Macarty This is an Action of Detinue damages $1,000- amt sworn to $700- bail
is required in the sum of Filed 15th Augt 1826 (Right) Service 1.~ United States of America Arkansas Territory Conway (formerly Pulasky) County Sct St Lanusse Nee Macarty St Lanusse Nee Macarty Complains of William Flanakin of a plea that she
the defendant Tendered to him the plaintiff one Mulatto Boy Slave Named
Toby of grate value To witt of the value of Seven hundred dollars which
from her the defendant unjustly detains. The Clerk of the Superior Court will please issue a Capias in Detinue
on the foregoing declaration and endorse the same on action of Detinue
Damages one thousand dollars [non Detienit] & properly in defendant in short hand by consent &
Joinder Charles Caldwell attorney in fact for St Lanusse Nee Macarty of Lawfull
age being duly sworn Testifies and Says that the property in the foregoing
declaration mentioned is to the best of his knowledge and belief the property
of the Said St Lanusse Nee Macarty and [missing text] fully enabled to
the [missing text] he believes the property is [missing text] value of
Seven hundred dollars. And that he believes that William Flanakin the
Said defendant unlawfuly detains the same St Lanusse nee Macarty the within named Plaintiff having filed in my
office and Affidavit stating that the property in the Declaration mentioned
is her property, and that she is lawfully entitled to the possession thereof,
and that the same is of the value of Seven hundred dollars; It is therefore
Ordered that the Defendant be held to bail in the Sum of Fourteen hundred
dollars- St Lanusse nee Macarty To October Term 1826 Territory of Arkansas, To the Sheriff of Conway County Greeting: IN TESTIMONY WHEREOF, I have hereunto set my hand as Clerk, and affixed
the seal of office, this 15th day of August 1826, and of the Independence
of the United States the forty-first (Stamped seal)
