Joseph Paxton v. Robert Crittenden & William Trimble

This deed of bargain and contract made and entered into by and between Robert Crittenden and Ann Crittenden his wife and William Trimble and Lunetta Trimble his wife of the first part and Joseph Paxton of the other part witnesseth that the said party of the first part for and in consideration of the sum of four thousand dollars to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged hath this day given granted bargained and sold and by these presents doth give grant bargain sell convey and confirm unto the said party of the second part his heirs and assigns forever a certain lot or parcel of ground situate lying and being in the town of Little Rock and designated and known in the map of said town by lot number one in Block number one. Together with all and singular the rights members particulars and appurtainances to the same belonging or in any wise appertaining and particularly the exclusive right of keeping a public ferry a cross the river Arkansas from the Little Rock, as the same is secured by a bill of assurances made and executed by William Russell, Henry W. Conway, Robert Crittenden, William Trimble, Robert C. Oden, Thomas P. Eskridge, & Joseph Hardin bearing date on the twentieth day of November in the year of one thousand eight hundred and twenty one, to have and to hold the said lot or parcel of ground together with the rights members privileges [Image of page 2] and appurtainances aforesaid, to him the said Joseph Paxton his heirs and assigns forever. And the said party of the first part for the consideration aforesaid do hereby covenant and agree, promise and oblige themselves their heirs and assigns to convey to said Paxton by deed with general warranty a certain lot or parcel of land lying and being in the county of Pulaski and Territory of Arkansas containing one acre and one half acre being the same that was selected by said Crittenden and Trimble out of a preemption right lying on the Arkansas River opposite to a place called Little Rock as the same has been designated and surveyed by the said Crittenden and Trimble according to the stipulations contained in a memorandum of an agreement made and entered into with said Crittenden and Trimble by William Russell bearing date the 26th day of November 1821 – to have and to hold the said acre and one half to said Paxton his heirs and assigns forever in fee simple together with the exclusive right and privilege of keeping a public ferry a cross the Arkansas River and all right of fereage exclusively that may attach to the north west fractional quarter of section number two and north east fractional quarter of section number three in town number one north in range number twelve west of the fifth principal meridian and the party first above mentioned doth further covenant and agree to guarantee a road over and through the above mentioned [Image of page 3] fractional quarters of sections with the limitations and restrictions contained in the said memorandum of an agreement made and executed by said William Russell to the said Crittenden and Trimble bearing date the 26th day of November 1821.
In testimony whereof the said party of the first part hath hereunto set there hands and seals the 10th day of July in the year of our Lord eighteen hundred and twenty four.

Be it remembered and it is hereby certified that on the 14th day of July A.D. 1824 Personally appeared before the undersigned clerk of the circuit court for the county aforesaid, Robert Crittenden, and Ann J. Crittenden his wife party grantors to the within and foregoing deed of conveyance and acknowledged the same to be their act and deed, for the purposes therein mentioned and contained and the said Ann J. Crittenden, being by me made acquainted with the contents of the same, and examined separately and apart from her said husband, acknowledged that she voluntarily executed the same, for the uses and purposes therein mentioned, without fear or coercion from her said husband.
