To the superior court in and for said Territory April Term in the year of our Lord eighteen Hundred and twenty seven

Wm Cummins by attorney complains of Alexander W Cotton of a plea of Trespass on the case For that whereas the said Alexander W Cotton heretofore to wit on the [ ] day of April in the year of our Lord eighteen hundred and twenty six at the town of Little Rock County of Pulaski and within the jurisdiction of this Court was indebted to the said Cummins in the sum of One hundred Dollars for the work and labour care dilligence and attendance of the said Wm Cummins by him the said Cummins before that time have performed and bestowed as attorney on the retainer and at the special instance and request of the said, Alexander W Cotton in the defence of one Allen Cotton the brother of said Alexander W Cotton who (the said Allen) was indicted for the crime of murder at the April term of the superior Court in the year eighteen hundred and twenty six. And also for this the work and labour care and dilligence of the said Cummins and being so indebted he the said Alexander W Cotton in consideration thereof afterwards to wit on the day and year last afsd at the town of Little Rock afsd & county afsd undertook and then and there faithfully promised the said Cummins the said sum [Image of page 3] to pay him the said sum of one hundred dollars when he the said Alexander W Cotton should be thereunto afterwards requested. Yet the said Alexander W Cotton not regarding his said promise and undertaking but contriving and craftily and subtly intending to deceive and defraud the said Cummins in that respect hath not although often requested so to do) as yet paid the said sum of money or any part thereof but hath wholy neglected and refused and still doth neglect and refuse so to do. to the damage of the said Cummins two hundred Dollars and therefore he brings suit
