Know all men by these presents, that we David Miller, William Montgomery and Robt. Crittenden, have this day formed and associated ourselves in co-partnership, to be called and known under the name and tittle of David Miller &co for the following purposes recited and for no others - the said Montgomery and Crittenden being the lawful owners and proprietors of a certain pre-emption right at the mouth of the White River deem it essential to our mutual interest - that that an establishment should be made at the said place, which should have for its object, the keeping of a woodyard fresh meats and vegetables, for steam boats on the Mississippi River as well as groceries and generally the produce raised and exported to New Orleans from the upper country for the purpose of supplying the Territory generally - all the above parties for the affectuation of the above objects, do authorize and empower each other to affix the name of the firm to any obligations not exceeding ten thousand dollars, which obligation or obligations when so signed we do by these presents acknowledge as equally binding on all the parties - on or before the first day of January 1822, we do bind ourselves to consolidate fund of five hundred dollars each in the hands [of] David Miller (who is to reside at White River, and keep the books of the firm) to be applied in trafick for the mutual advantage of the Three - and it is greed among the parties that a dividend and a settlement shall be made every twelve months, or oftner at the demand of either of the parties to this obligation - and that the profits shall be equally divided, and all losses equally sustained - this partnership to exist two years from and after this date - unless either of the parties die, in that event the partnership will be considered as stoped from the date of his death - and for the fulfillment [Image of page 3] of all and singular the above purposes, and to effectuate the ends proposed, we pledge our properties, and sacred honours - given under our hands and seals this thirtieth day of Nov 1821
