United States v. Joseph Davis
Deposition of David Gartman and Moses Newman

David
Girtman of Lawful age being duly sworn upon his oaths Deposeth and saith
that about the Last of February or the first of March in the year of 1826
He this Deponent, was possessed of the horse, in the Deposition of Moses
Newman first above mentioned as of his own property and that about that
time said horse was missing and this deponent Did not know what had become
of him at that time, that some time in July or August 1826 he this Deponent
found said horse in the possession of one Hirium Hudson that said horse
when so found had the appearance of having been very much injured, with
hobbles with which he seemed to have been confined. this Deponent further
states that he never Disposed of Said horse to any person or persons whomsoever
and that said horse is still his property and that he this deponent verily
believes [Image of page 2] that said Horse was
felloneously stolen taken and carried away either from the immediate possession
of this Deponent or from the range in Clark county to which he may have
strayed, that this Deponent had no acquaintance with said Joseph Davis
mentioned in said Deposition of said Moses Newman, having never seen him
but once before that time of the sale as mention by said Newman of said
Horse by him to said Newman that said Davis lived and resided about
two and one half or three miles from the place at which this deponent
then lived and on which he had resided Sworn to and Subscribed before me this 19th day of May 1827 Territory of Arkansas The Deposition of Newman produced sworn and examined before the Judge of the 3rd Judicial circuit in said Territory at the court house in the town of Biscoville in the county of Clark aforesaid on the 19th day of May in the year of our Lord 1827 Moses Newman of Lawful age being produced sworn and examined on the part
of the United States upon his oath Deposeth and saith that Some time in
the month of June in the year of our Lord 1826 in the county of Clark,
he purchased a certain horse of Joseph Davis about one year old in the
spring then Last past, which said horse he believes was then worth fifteen
dollars current money of the United States and this Deponent further states
that about eight or nine days previous to the purchase of sd horse from
said Davis he this Deponent [Image
of page 4] Saw Said Davis with one Wm Mcfaddin going towards the Arkansas
River riding on horse back and on their return they had in their possession
two other animals than those they took with them of which the horse first
above mentioned was one, and this Deponent further states that he then
lived about fifteen or twenty miles from the residence of said Davis -
that said Davis sold the said horse first above mentioned as his on property
that this Deponent after the purchase of said horse from said Davis he
this Deponent sold the same to Hirium Hudson Sworn to and subscribed before me the 19th day of May 1827 |
