Ss. In the Superior Court for Said Territory at their October Term A.D. 1827

The grand jurors of the United States empaneled charged and sworn to enquire in and for the body of the Territory aforesaid upon their oath present and say.

That Joseph Smith Johnson late of the County of Pulaski and Territory aforesaid on the Seventh day of October one thousand Eight hundred and twenty Seven with force and arms at the county of Pulaski aforesaid with a certain Pistol loaded with gun pow powder and a leaden bullitt felloniously maliciously and unlawfully and willfully did shoot at one William Montgomery and he the Sd Joseph Smith Johnson then and there did felloniously maliciously unlawfully and willfully shoot with intent in so doing that is to say in so shooting at the said William Montgomery by means thereof felloniously, and of his malice aforethought to murder him the sd William Montgomery against the form of the Statute in such case made and provided and against the peace & dignity of the United States.

And the Jurors upon their oath present and say; that the Sd Joseph Smith Johnson on the Seventh day of October A.D. one thousand Eight hundred and twenty-seven with force and arms at the County of Pulaski aforesaid with a certain pistol loaded with gun powder [Image of page 3] and a leaden bullett felloniously wilfully maliciously and unlawfully did shoot at the said William Montgomery with intent in so doing, that is to say in so shooting at the said– William Montgomery and by means thereof to maim & disable him the Sd William Montgomery against the form of the statute in such case made and provided and against the peace and dignity of the United States. The like with intent in so doing, to wit,– in so shooting at the Sd William Montgomery and by means thereof to do some grievous bodily harm to him the said William Montgomery against the form of the Statute in such case made and provided and against the peace and dignity of the United States.

And the Jurors upon their oaths present and say that the Sd Joseph Smith Johnson on the said seventh day of October in the year aforesaid with force and arms at the County of Pulaski aforesaid with a certain pistol loaded with gun power and a leaden bullett felloniously wilfully maliciously and unlawfully did shoot at the Sd William Montgomery then & there being with intent in so doing and by means thereof then & there felloniously wilfully and of malice aforethought to murder him the said William Montgomery against the form of the Statute in such case made and provided and against the peace and dignity of the United States.

And the Jurors upon their oaths present and say; that the Said Joseph Smith Johnson on the seventh day of October A.D. one thousand [Image of page 4] Eight hundred and twenty seven with force and arms at the County of Pulaski aforesaid with a certain pistol loaded with gun powder and one leaden bullett felloniously wilfully maliciously unlawfully and knowingly did shoot at & with intent to kill the Sd William Montgomery the said William Montgomery then & there being in the public street in the town of Little Rock and county & Territory aforesaid against the form of the Statute in such case made and provided and against the peace and dignity of the United States.
