The Grand jurors of the United States impanneled in the county of Pulaski aforesaid at the April Term of the Superior Court holden at the court house in the Town of Little Rock in and for the Territory aforesaid in the year of Christ one thousand eight hundred and twenty eight and who were charged and sworn to enquire in and for the body of the Territory aforesaid upon their oaths do present that John Smith late of the county of Pulaski aforesaid labourer not having the fear of God before his eyes but being moved and seduced by the instigation of the devil on the thirteenth day of December in year of our Lord eighteen hundred and twenty seven with force and arms at the Town of Little Rock in the county of Pulaski aforesaid in and upon one Isaac Watkins in the peace of God and of the United States then and there being feloniously willfully and of his malice aforethought did make an assault and that the said John Smith a certain rifle gun of the value of one dollar then and there charged with gun powder and one leaden bullet which said rifle gun in the said John Smith in both his hands then and there had and held then and there feloniously wilfully and of his malice aforethought did discharge and shoot off against and upon the said Isaac Watkins and that the said John Smith with the leaden bullet aforesaid out of the rifle gun aforesaid then and there by the force of the gun powder aforesaid by the said John Smith discharged and shot off as aforesaid then and there feloniously wilfully and of his malice aforethought did strike penetrate and wound the said Isaac Watkins in and upon the left side of the breast of him the said Isaac Watkins near the left half of him the said Isaac Watkins [Image of page 3] giving to him the said Isaac Watkins then and there with the leaden bullet aforesaid so as aforesaid discharged and shot out of the rifle gun aforesaid by force of the gun powder aforesaid by the said John Smith in and upon the left side of the breast of him the said Isaac Watkins near the left half of him the said Isaac Watkins one mortal wound of the depth of six inches and of the breadth of half an inch of which said mortal wound he the said Isaac Watkins then and there instantly died and so the jurors aforesaid upon their oaths aforesaid do say that the said John Smith him the said Isaac Watkins in manner and form aforesaid feloniously wilfully and of his malice aforethought did kill and murder against the form of the statute in such case made and provided and against the peace and dignity of the United States
