Arthur Dillingham v. Jacob Skein

Dillingham Filed 23rd January 1832 Territory of Arkansas English by Jacob Skein his representative. Francis Williams on a receipt
which Williams gave English for the collection of sundrie notes and &c.
after examining the matter judgement the judgment is rendered against
the plaintiff for one dollar and cost of suit. Given under my hand this
12th day of May 1830. Natitoches April the 5th 1826 This day rec'd of William English the following notes for collection
and Recpts one Recpt on B. Clark for $44.50 one on L. W. Boyington for
the sum of 268.00 one on L. W. Boyington for 87.00 one certificate Plat
for the sum of 360.00 on L. H.Boyington and Clack Stone which notes and
accounts he is to collect on them as he may think best and after deducting
his ? amt of said affects to account to me for the ballance as return
said notes or accounts. Filed in my office on the 3rd day of June 1831 Demand from ? pay for ? June the 3rd 1831. This day came [the] plaintiff as well as the defendant in proper person and after hearing what testimony was adduced I give judgment for plaintiff for seventy dollars and costs of suit. Constable fees: Justices fees Appeal prayed for on the 6th of June and Bond taken. Territory of Arkansas Greeting You are hereby commanded to subpoena Daniel Tomison of Cane
Hill Township that all excuses and delays set aside that he be and appear
before me a justice of the peace in and for the county aforesaid at my
dwelling house on Friday the third day of June against ten oclock in the
forenoon of said day to testify the truth of his knowledge on a certain
matter of controversy before me pending wherein Jacob Skein is plaintiff
and Arthur Dillingham is defendant on the part of the plaintiffs you are
not to fail and fail not at your peril and have you then and there this
writ. Subpoena I do certify that I served the within subpoena on Daniel Tomison of Cane
Hill Township on the 26th day of May 1831 by reading the same to him at
his own house. Constable fees: Jacob Skein Territory of Arkansas I Henry Tallett a justice of the peace within and for the county aforesaid
do certify that the foregoing is a true statement of the judgment had
before me at the day and date aforesaid and that the papers herewith sent
up are all in my possession and that have been since the commencement
of the said suit. Arthur Dillingham Account against Arthur Dillingham filed in my office on the 24th day
of May 1831 Territory of Arkansas Greeting Summons Arthur Dillingham to appear before me a justice of the
peace on the third day of June at my dwelling house between the hours
of ten in the forenoon and three oclock in the after noon of said day
to answer Jacob Skein in an action of debt on an open account under one
hundred dollars. May the 12th 1831 William Inglish against Francis Williams by Jacob Skein one receipt of
eighty seven dollars judgment given in favor of Williams for one dollar
and cost of suit this day and date when given under my hand and seal. Jacob Skein I do certify that I served the within summons by leaving a true copy
of the same at his own house in the hand of his wife Jane Dillingham in
Prairie Township on the 27th day of May 1831 Constable fees: Territory of Arkansas Jacob Skein And now on this day came the partys by their attorneys and a jury being called came as follows to wit Saml Osick, Isaac Herrell, John C. Blair, Alexander Caultor, David Mitchell, Burton Billingsly, Moses Graham, William L. Weddington, Robert McCarney, Jeremiah Riddle and Robert McFall twelve good and lawful men of the bailiwick who being duly elected tried and sworn and having heard the evidence retired to consider of their verdict and returned into court the following verdict to wit we the jury find for the plaintiff seventy one dollars seventy five cents. Robert McCarney there fore it is considered by the court that the said plaintiff have and recover of said defendant Arthur Dillingham the said sum of seventy one dollars and seventy five cents together with his costs by him about his suit in this behalf expended &c. Territory of Arkansas I, B. H. Smithson Clerk of the Washington Circuit Court do hereby certify that the within and annexed is a true copy as appears to me of record in my office. In testimony whereof I have hereunto set my hand and affixed the seal
